Water availability in Costa Rica: the complete guide for foreign buyers

If you are buying land or developing in Costa Rica, one document rules them all: the water availability letter (constancia de disponibilidad de agua). Without it, there are no construction permits, no plan approvals, and most banks will not finance. Many foreign buyers learn this after closing on a property.

Who issues it? Depending on the location: AyA (the national water institute), a local ASADA (community-run rural aqueduct), or a municipality. Coastal areas like Santa Teresa, Nosara and parts of Quepos are mostly served by ASADAS — small organizations with limited capacity and their own requirements.

The healthy sequence is: verify water before you buy. A water due diligence study costs a fraction of the property price and tells you exactly what you are buying: existing availability, distance to the nearest network, the operator's real capacity, and the probable route if there is no service today.

What if the answer is no? A negative letter is not the end. In our experience across 50+ availability cases, there are five routes: building a line extension (AyA grants availability conditioned on infrastructure you build), funding the ASADA's technical study (often the real bottleneck), obtaining a water concession from MINAE for a well, an Article 38 public-private agreement, or — when files stall without grounds — administrative appeals, which we have used successfully.

A real example: in Quepos, a foreign developer's project required 2.2 km of pipeline, a national road crossing and an easement over neighboring land. We designed, permitted, built and delivered the work until AyA formally received it. That developer has since entrusted us with two more projects.

The takeaway: water in Costa Rica is solvable — with engineering, local institutional knowledge and patience. Start with a diagnosis, not with assumptions.
